Terms of service Agreed Upon when Purchasing from www.codyresidential.com
Communication:
Office hours Mon-Fri 9am-5pm (please allow 24-48 hours response time)
Email and scheduled calls and meetings are our primary methods of communication for record purposes.
Text messaging is not permitted for record purposes.
Order: Cody residential reserves the right to not accept any project.
Selection Schedule:
The client shall provide their selection approvals/denials within 72 hours of being presented. In the event that the client fails to provide a selection decision within the agreed-upon timeframe, the design in its entirely is considered approved. This is to keep the project moving forward. The service provider shall notify the client in writing of the pending approval and the client has 48 hours to rectify the approvals.
Shipments & Delivery:
you, the client is responsible for the purchasing, shipping, delivery, and installation of all items. the design fee purchased from cody residential does not include any physical items.
Revision Limitation:
a. The service provider shall provide the client with a maximum of 1 round of revisions for the services or deliverables outlined in this contract.
b. If the client requires revisions beyond the allocated rounds, additional revisions shall be subject to an additional cost. The cost for each additional revision shall be determined based on the nature and extent of the requested changes and shall be mutually agreed upon by both parties before any additional work is undertaken.
c. The service provider shall notify the client in writing of the applicable costs for additional revisions prior to commencing any work beyond the allocated revisions.
Purchasing and Warranty Terms
This contract does not include any physical product. All product purchases to be laid out in a separate purchasing agreement.
Payment and Refund Cancellation Terms
No refunds on services as this is a time based service and not a physical product.
Cash, Venmo Business, or Credit Cards accepted by Honeybook are applicable.
Consultants and Contractors Clause
Cody Residential, LLC is not responsible for any 3rd party contractors or consultants or their work.
Photograph, Videography, and Publicity Terms
Cody Residential, LLC will be personally and professionally photographing and/or taking video of the space (before, during, and after) for social media and marketing purposes and will not release any personal client information. You agree that your client testimonial and/or any uploaded material throughout the duration of your project may be used for marketing purposes.
Intellectual Property Clause
All presentation and concepts are owned exclusively by Cody Residential and should not be used, copied, or distributed without written permission. This includes all design drawings, PDFs, details, permits, 3D renderings, color combinations, etc. The interior designer retains the ownership of the interior design concept, copyrights, sketches, plans and 3D drawings, samples, swatches, intellectual property, patents, and any other materials prepared for the project.
Termination Terms
At any point, Cody Residential, LLC reserves the right to terminate the contract without a refund. The client reserves the right to terminate the contract in its present phase and submit the concurrent AND following payment in lieu of finishing the project. (not applicable for E-design services of any kind)
Resolution of Disputes & Indemnification
No outside or further legal action can be taken against Cody Residential, LLC outside of the above terms. In the event of a dispute, client and Cody Residential, LLC will work together to come to a new agreement to be signed by both parties. You agree to indemnify www.codyresidential.com harmless against legal claims and demands that may arise. We reserve the right to select our own legal counsel.
